BYE LAWS  OF THE ALL J & K +2 PSC LECTURERS ORGANISATION

(This shall provide a base to form most comprehensive byelaws and any suggestion


comments and criticism from the basic members and experts are most welcome)


PREAMBLE


We, all the Lecturers recruited by Jammu and Kashmir Public Service Commission


under Direct quota and working as Confirmed Lecturers in the Department of School


Education Govt. of J & K State, do hereby establish and adopt this constitution/ bye-

laws in order to institute procedural protocol, establish the membership of the body,


and govern the activities of the organization.


ARTICLE I: RECOGNITION OF THE NAME


The name of this organization shall be “THE ALL J&K +2 PSC LECTURERS


ORGANISATION”


“J” means the Jammu Province


“K” means Kashmir Province with Leh and Kargil


“+2” means Higher Secondary Level of School Education


“PSC LECTURERS” means all those lecturers working in School Education


Department of J & K State who have been recruited by J & K PSC Srinagar/ Jammu


“Organisation” means elected body of lecturers.


ARTICLE II: THE STATED PURPOSE


The sole objectives of the organisation are outlined as under:


⇒ To unite all PSC recruited Lecturers for fighting their genuine agenda


through legal and peaceful means.


⇒ To bring par excellence in the overall academic atmosphere of J & K State.

⇒ To bring sanctity in the conduct of examination by extending full support


and co-operation to the authorities of JK BOSE and other examining


agencies.


⇒ To launch website in the name of J&K +2 PSC Lecturers Organisation.


⇒ To motivate lecturers having research aptitude for producing original


research papers in their areas of interest by publishing bi-annually research


based journal.


⇒ To work for the creation of Lecturers Welfare Fund.


⇒ To give cognizance to honest, dedicated and efficient teachers/ lecturers


through prizes and awards by celebrating Lecturers and Teachers day.


⇒ To work for restoration of respect and esteem of teaching community.


⇒ To highlight the genuine issues of lecturer fraternity before the concerned


authorities.


⇒ To motivate higher authorities through legitimate means for redressal of


issues confronting by the PSC recruited Lecturers.


⇒ To purchase land and to construct office complexes with all modern


facilities for the organisation both at Srinagar and Jammu.


ARTICLE III: MEMBERSHIP


The Lecturers working in Department of School Education Govt. of J & K State and


recruited by Jammu and Kashmir Public Service Commission under Direct quota


shall become only the basic members of the All J&K +2 PSC Lecturers Organisation.


ARTICLE IV: PROCEDURE TO BECOME MEMBER


A PSC recruited Lecture shall have to furnish complete bio-data and service


particulars on prescribed format along with the membership fee of Rs 500/= against


proper receipt of All J &K +2 PSC Lecturers Organisation. The membership is valid


for three years only and after the expiry of three years all PSC recruited Lecturers


have to seek renewal of their membership by depositing Rs. 300/=


ARTICLE V: FUNCTIONS OF BASIC MEMBERS


o Members should give first and foremost priority to the fulfillment of their duties


for which they are being paid by the Govt.


o Members should always be in quest to upgrade their knowledge for imparting


current and up to date knowledge in the classrooms.


o Members must demonstrate active participation in all activities and programmes


of the organisation.

o Members should not hesitate to write suggestions, comments and criticism


to the Provincial Level President and District Presidents regarding the further


development and progress of the organisation.


o Member must be resourceful and active towards the organisation for all times.


ARTICLE VI: WHEN MEMBER CEASES TO BE A MEMBER.


A person may cease to be member for any one of the following reasons;


⊗ On account of his/ her death


⊗ On resigning from the membership


⊗ On attending retirement on superannuation


⊗ On account of his /her default in paying his/her membership


⊗ On account of his/her violation to the rules of this bye-laws


⊗ On account he / she turn insane.


⊗ On account he / she acts against the cause of this organisation


ARTICLE VII: HEAD QUARTERS


The head quarters for All J & K +2 PSC Lecturers Organization will remain at


Srinagar summer capital for the months of May to October and at Jammu winter


capital of J &K State for the months of November to April and accordingly the


Separate Provincial Level Central Executive Bodies elected for Jammu and Kashmir


shall remain active and operative at their headquarters as per the schedule of darbar

ARTICLE IX: THE PROVINCAL LEVEL CENTRAL EXECUTIVE BODY


CHIEF PATRON: Any Central Executive Member having service of not less than 15


years is eligible to be selected as Chief Patron. Patron has power to guide, supervise


and monitor over all functioning of the Organisation. Prior information should be


given to patron regarding the programmes of organisation.


ARTICLE X: PRESIDENT


Qualification: A member of central executive body of any district shall contest for the


position of president if he/ she fulfills following eligibility:


⇒ Should be the basic member of the organisation


⇒ Should be a member of central executive body of any district


⇒ Should have successfully completed the probation as per the J & K Gazetted


Education Service Rules


⇒ Should not have been debarred by the JK BOSE


⇒ Should not be involved in any subversive, criminal and unlawful activity.


⇒ Should not have less than three years of remaining service.


Functions of President: The President must ensure responsibilities of the


Organisation described herein are faithfully executed and must serve to protect the


mission and interests of the organization.

(a) The President will be elected by a simple majority vote of the members of central


executive representing various districts for a term of 3 years


(b) The President must be present at ninety percent of the meetings of Organisation.


(c) The President will preside at all meetings of the Organisation that s/he attends.


(d) The President will serve as the primary liaison between the Government of J &


K State and the Lecturers Organisation, which refers to all communications and


media-related concerns including public announcements, interviews, and the

(f) The President has authority to operate upon the Account of All J&K PSC+2

(g) No expenditure of funds shall occur without the consent of the President


(h) The President may establish committees to address and investigate concerns of


the Lecturers as necessary.


(i) In the case of the removal of the President from office, or his/her death,


resignation, or inability to discharge the powers and duties of the office, one of


the Vice Presidents to whom the central executive body will elect shall become a


President and the post of vice president shall be filled from members of central


ARTICLE XI: VICE PRESIDENTS


Three vice presidents shall be elected from the central executive members of various


districts and each has to pass the same eligibility criterion as has been fixed for the

ÿ The Vice Presidents are responsible to extend their warm cooperation to


President in day to functions of the organisation


ÿ Vice President shall preside over the meetings of Central Executive in the


absence of President and shall enjoy all powers of the president in his


absence for the time being.


ÿ Vice President shall work as ex officio chairman of the audit committee.


ÿ Vice President shall work closely with Treasurer to ensure proper


documentation of the expenditure incurred for various programmes of


Organisation.


ÿ Vice presidents representing various district central executive bodies have to


work for maintaining strong link between Provincial Level Central Executive


body and District Level Central Executive Body

ÿ Vice Presidents along with Chief Coordinator and district coordinators shall


be responsible for the collection of membership fee and other donations from


District Presidents for Provincial Level Central Executive Body


ÿ The Vice Presidents shall report to the President and is delegated specific


duties and responsibilities by him/her.


ÿ In case of vacancy or resignation of the president, vice president shall


use all powers and functions of the president and shall make necessary


arrangements for electing or selecting new president as soon as possible


ARTICLE XII-GENERAL SECRETARY


The General Secretary with the assistance of other three Secretaries of the


Provincial Level Central Executive is responsible for maintaining an organized state


of affairs within and throughout the organization.


(a) The General Secretary will take minutes and attendance at meetings of

ARTICLE XIII SECRETARIES


The three secretaries shall be elected from the members of central executive


bodies of various districts to assist the General Secretary of the Organisation. The


secretaries shall have to carry the functions of General Secretary in his/ her absence.


The secretaries shall have to keep available all time complete and up to date


information about the PSC Lecturers working in Department of School Education.


ARTICLE XIV: PUBLICITY SECRETARY


The publicity secretary shall be selected on the basis of consensus of the members


of Central Executive Body and should possess command over the writing skills. His


work in the organisation is defined as under:


¸ He shall be responsible for publishing the proceedings of the meeting


and decision taken by the central executive body.


¸ He shall be responsible for all queries and comments received after


publishing the press releases.


¸ He/ She has to keep the record of all publishing material


¸ He has to maintain the dispatch register of all publishing material.

¸ He has right to keep minimum Rs. 1500/ with him from the funds


of organisation for meeting out the expenditure of advertisement of


notices and press releases.


ARTICLE XV; CHIEF ORGANISER


Chief Organiser shall be elected out of central executive members by simple majority


of vote and has to function in following manner:


v Shall have to organize meetings relies conventions etc as decided by


the central executive


v He/ She will inform the president and executive members regarding


the problems of + PSC Lecturers after visiting the various institutions


along with the other three organizers.


v He /She shall be responsible along with the assistance of Chief


Coordinator to schedule meetings and appointment with authorities


and Govt. to be visited by the Organisation.


ARTICLE XVI: CHIEF CORDINATOR


Chief coordinator shall be elected out of central executive members by simple


majority and his jurisdiction of work shall be as under:


 He/ She have to coordinate between the district bodies and the central body


with the help of district coordinators.


 He/ She along with the district coordinators have to help the vice presidents of


the organisation in the collection of funds.


ARTICLE XVII: TREASURER


(a)The Lecture Organization will elect, by a simple majority, any central


executive member as Treasurer.


(b) S/he must maintain all finances of the Lecture Organisation, in accordance


with the financial policies set forth by the All J &K +2 PSC Lecturers


Organization.


(c) The Treasurer must maintain financial records and provide periodic budgetary


reports to the Organization.


(d) The Treasurer will be responsible for the timely completion of all budgetary


requirements that may be required by the organizations.


(e) S/he will be responsible for maintaining Cash books and Ledger and for


providing financial statements upon the call of the President.

ARTICLE XIX: SOURCE OF INCOME:


The organisation shall raise the funds through following sources:


(i) Membership subscription.


(ii) Sum received through donations from basic members


ARTICLE XX-FUND MANAGEMENT AND OPERATION OF THE BANK


ACCOUNT:


(i) Fund received from the different sources will be deposited in the account of


the Organisation in any nationalized bank


(ii) Treasurer and President will jointly operate the bank account of the


Organisation.


(iii) The account of the Society shall be audited annually by the audit committee


appointed by members of central executive members.


 (iv) The audited statement of account should contain income and expenditure


statement, receipts and payments, assets and liabilities, balance sheet and


Utilization certificate.


ARTICLE XXI: IMPEACHMENT


Any member of central Executive Body including office barriers of All J & K +2 PSC


Lecturers Organisation in violation of the organization’s purpose or Constitution or


found to be in dereliction of his/her duty by one-third (1/3) of the Executive Members

may be removed from office by the following process:

(a) A motion to impeach must be presented to the Central Executive Body
bearing the signatures of one-third of the Membership.

(b) All Members must receive written notice of the citation.
(c) The member cited in the request must be notified of recall and permitted

to appear at the next general meeting where the case will be open to

discussion among members of the Organisation. S/he will then be given
opportunity to respond to grievances noted.

(d) The President will oversee the process impartially.

(e) At least two-thirds (2/3) of Executive Members must be present at the recall

meeting, or the recall process must be suspended until this criterion may be

satisfied.

(f) After discussion and debate, a two-thirds (2/3) majority vote of members

present is required to remove a member. The vote will be taken by secret

ballot.

ARTICLE XXII MEETINGS

8i. Regular meetings of the Central Executive Body shall occur at least once

after every fortnight or as the holiday schedule permits.

ii. Every meeting shall be presided over by the President, and in the absence of

the President, vice by the President shall preside over the meeting.

 members of general body present at any meeting shall constitute the

quorum.

iv. No meeting shall take place in the absence of the General secretary except in

unavoidable circumstances and in the absence of General Secretary any of

the three secretaries shall take the note of minutes of meeting.

v. An emergency meeting of the Organisation shall be summoned in

extraordinary circumstances. On such occasion the members shall be given

at least two days notice.

vi. Discussion that have taken place in emergency meeting need to be placed

before the full meeting of the Central executive body when it meet next.

vii. In case of difference of opinion among the members and where there is equal

division the president shall have a right of casting a decisive vote.

viii.Any person wishing to speak at a Central Executive Body meeting might

seek permission from the Chief Spokes person who shall act as speaker in all

such meeting do so to regulate the proceeding of the meeting. The speaker

must recognize all participants and reserves the right to limit discussion in the

interest of time.

ARTICLE XXIII: ELECTIONS AND APPOINTMENTS

Those basic Members meeting all requirements of active membership as set forth

under Article III, IV & V will be eligible to vote.

(a) The Provincial body comprising upon President, vice presidents, General

Secretaries, Secretaries, Treasure, Chief organizer, Chief Coordinator

will be elected by a majority vote of central executive members of various

districts and the positions of Publicity secretary, organizers, Chief

Spokesperson, Chief Advisor and advisors shall be filled from the central

executive members on consensus basis keeping in view the ability of

member for a particular position. In the same way district bodies and

district central executive members will be elected from the basic members

of the organisation. All elections will be held after the term of three

years during the month of April in Kashmir Province and in the month of

November in Jammu Province

9(b) The Central Executive Body shall nominate Election Commission from

the basic members of All J&K +2 PSC Lecturers Organisation headed by

observers and the Chief Election commissioner to be appointed by the

Directors of School Education of Kashmir and Jammu.

ARTICLE XXIV: LEGAL JURISDICTION

All disputes pertaining to the organisation shall be settled in the courts of Srinagar

ARTICLE XXV: AAMMENDMENTS IN RULES AND REGULATIONS

Any amendments in rules and regulations of the bye laws will be passed by majority

of the members of Central Executive Bodies and it will be ratified with 51 % majority.

Amendments should be inconformity with the corresponding rules.
